Assault and Battery Charges We Post Bonds For

The 2026 county schedules set assault bail by who the other person was and how serious any injury was. Our bail cost guide shows the 10% math on any amount.

Simple Assault, PC 240

Under Penal Code 240, assault is an illegal attempt to injure someone, made with the present ability to do it. Section 241(a) sets the maximum at six months in county jail plus a $1,000 fine. The misdemeanor schedule lists Book and Release.

Simple Battery, PC 242

Penal Code 242 treats willful, unlawful force or violence on someone as battery, and 243(a) allows up to six months plus a $2,000 fine. The schedule lists Book and Release; felony probation or parole sends the arrestee to Magistrate Review.

Battery on an Officer or Protected Worker

Peace officers, firefighters, EMTs and emergency nurses doing their jobs are among the workers Penal Code 243(b) protects; a battery on one carries up to a year in jail. Magistrate Review follows, and a magistrate may release or hold the person until arraignment.

Battery Causing Serious Bodily Injury

Under Section 243(f)(4), serious bodily injury includes a bone fracture, a concussion, a wound that required extensive suturing or a loss of consciousness. A misdemeanor 243(d) booking goes to Magistrate Review, with a year in county jail as the misdemeanor ceiling.

Sections 243(c) and 243(d) are wobblers, so the prosecutor may file them as misdemeanors or felonies. The 2026 felony schedule treats felony 243(d) as a serious felony at $50,000 and sends felony 243(c) to Magistrate Review.

An Arrest in Montclair or Chino

Montclair and Chino border Pomona but sit in San Bernardino County, whose judges adopt their own bail schedule under Penal Code 1269b(c). Bookings there can end up at West Valley Detention Center in Rancho Cucamonga, and our agents write bonds there too.

Three Simple Steps to a Bail Bond

1

Initial Payment

Phone (888) 998-9511 whenever the arrest happens. Once you know the bail amount, you review and sign the agreement, then make a low down payment toward the standard 10% premium.

2

Customized Payment Plan

We split the remaining premium into a written payment schedule built around your budget. A long case adds no second premium, since California outlawed renewal premiums in 2022 (Penal Code 1276.1).

3

Securing Release

A licensed agent files the bond with the jail or station holding your relative. That facility sets its own release pace, and we keep your family posted until your relative walks out.

Assault Bail Bond FAQ

These answers rely on the Los Angeles County Superior Court's 2026 bail schedules and the Penal Code. A judge can change bail at arraignment, so treat each figure as a starting point.

You pay a premium of 10% of the bail amount. Felony battery with serious bodily injury carries $50,000 on the 2026 schedule, so the premium is $5,000, or $4,000 for a client eligible for a filed 8% rate. Simple assault lists at $0. Our cost guide has more examples.

Yes, when the charge carries money bail. Domestic battery under PC 243(e)(1) sits at $20,000 on the 2026 schedule, and PC 1270.1 bars a $0 release before an open-court hearing. Simple assault or battery alone, after an arrest without a warrant, lists at $0 until arraignment.

Not after a warrantless arrest where the Pre-Arraignment Release Protocol sets $0 bail on every charge. A warrant carries the bail its judge endorsed (PC 815a). Under Magistrate Review, a magistrate may let the person go or keep them jailed until arraignment, and your family can't post a bond before then.

A $1,000 bail figure costs $100 in premium at the usual 10%, or $80 at a filed 8% rate for those who qualify. For comparison, PC 245(a)(1), assault using a non-firearm deadly weapon, lists at $30,000 on the 2026 felony schedule, a $3,000 premium.

Not for the unpaid balance alone; jail risk comes from surrender or a missed court date. An agent may surrender the defendant, but surrendering before the court date means refunding the premium (10 CCR 2090, narrow expense exceptions aside), and a judge may order it back under PC 1300(b) absent good cause.
